Terms of service

1. Who we are and what these terms cover

Rowsafe is operated by Adraa Labs (“Adraa Labs”, “we”, “us”). These terms apply to the Rowsafe website, dashboard, API, command-line tools, agent and related services (the “Service”). By creating an account or using the Service you agree to them. If you use Rowsafe for an organization, you confirm you may accept these terms on its behalf.

2. The Service

Rowsafe installs a software agent on servers or containers that you control. The agent configures continuous backups of your databases to storage that you own, runs scheduled backups and restore checks (“drills”), and reports health and performance information to our control plane, which shows it in the dashboard and sends alerts.

Some features may be described as upcoming or “coming soon”. They are not part of the Service until we make them available.

3. Your account

You need an account to use the dashboard. Give us accurate information, keep your login, API keys and enrollment tokens secure, and tell us promptly at [email protected] if you think someone has accessed your account without permission. You are responsible for activity under your account and your API keys, including actions taken by AI agents or tools you connect.

4. Your responsibilities

Rowsafe is designed so that your data and keys stay under your control. That also means some things are yours to look after:

• Your data. You own your databases and everything in them, and you are responsible for having the right to store and process it.
• Your storage bucket. Backups are stored in a bucket on your own account with your storage provider. You pay that provider, keep the bucket available, and must not delete objects Rowsafe relies on.
• Your encryption passphrase. Backups are encrypted on your server with a passphrase only you hold. We never receive it. If you lose it, your backups cannot be restored by anyone.
• Your servers. You keep your servers, operating systems and databases secure and supported, and you choose when to restart your database.
• Restores. You decide when and where to restore, following our documentation, and you check the result before relying on it.
• Your own copies. For critical data, keep an independent copy or backup method, especially while you are setting Rowsafe up.

5. Acceptable use

Don't use the Service to break the law or harm others. In particular, don't:

• use it for data you have no right to process;
• try to access accounts, data or systems that aren't yours, or probe, scan or test our systems without our written permission (responsible security reports are welcome, see Contact);
• interfere with or overload the Service, or work around plan limits or security controls;
• resell the Service or use it to build a competing product without our agreement.

6. Open-source components

The agent, command-line tools and installer are open source under the Apache License 2.0, and that license governs your use of their code. The control plane, dashboard and website are proprietary; these terms govern your use of them.

7. Plans, payment and cancellation

The Free plan costs nothing and has the limits shown on our pricing page. Paid plans are billed monthly in advance. Payments are processed by Polar, our merchant of record, which also handles sales tax and VAT and issues your invoices.

You can cancel anytime from the dashboard. Your plan stays active until the end of the paid period, then your organization moves to the Free plan. Refunds are described in our refund policy.

We may change prices with at least 30 days' notice. A price change applies from your next billing period after the notice.

8. Availability and support

We work to keep the Service available and to fix problems quickly, but we don't promise it will be uninterrupted or error-free. Planned maintenance and events outside our control can affect it.

Rowsafe is built so that continuous backups keep running on your server even when our control plane is unavailable. Scheduled backups, restore checks and alerts resume when it returns.

9. No guarantee of recoverability

Rowsafe greatly reduces the risk of losing data and checks every week that your backups can be restored, but no backup system can guarantee that every piece of data is always recoverable. Recovery depends on things outside our control, including your servers, your storage provider, your network and your encryption passphrase.

Except for what we expressly commit to in these terms, the Service is provided “as is” and “as available”, and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows.

10. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, and each party's total liability arising out of or relating to the Service is limited to the amounts you paid us for the Service in the 12 months before the event giving rise to the claim (or USD 100 if you only used the Free plan).

These limits don't apply to liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.

11. Suspension and termination

You can stop using the Service and delete your organization at any time. Uninstalling the agent never touches your database or your bucket.

We may suspend or terminate access if you seriously or repeatedly break these terms, if you don't pay, or if we need to protect the Service or other customers. Where reasonable we'll warn you first and give you time to fix the problem. After termination we delete your account data as described in our privacy policy. Your backups stay in your bucket.

12. Changes to these terms

We may update these terms. For material changes we'll notify account owners by email or in the dashboard at least 30 days before they take effect. If you keep using the Service after that, the new terms apply.

13. Governing law

These terms are governed by the laws of [jurisdiction to be confirmed], and disputes will be handled by the courts of [jurisdiction to be confirmed], unless mandatory consumer law gives you other rights.
